1. Data Controller Identification
QuantumOrbitWorks, located at Calle del Párroco Eusebio Cuenca 54, Piso 7 C, Madrid, Spain, ("Data Controller"), is responsible for the processing of personal data collected through our digital platforms and service delivery channels.
2. Legal Basis for Processing
We process personal data under the following legal bases as defined in Article 6 of the EU General Data Protection Regulation (GDPR):
- Consent (Art. 6(1)(a)): When you subscribe to our communications or submit contact forms.

4. Data Retention Periods
Personal data is retained only for the duration necessary to fulfill the purposes for which it was collected:
- Contact form submissions: 24 months from last interaction
- Contractual data: Duration of the agreement plus 6 years (Spanish commercial law)
- Technical logs: 12 months maximum
- Marketing consent records: Until withdrawal of consent
5. International Data Transfers
QuantumOrbitWorks operates within the European Economic Area (EEA). Where data transfers outside the EEA are necessary, we ensure adequate protection through Standard Contractual Clauses (SCCs) or adequacy decisions as per Chapter V of the GDPR.
6. Data Subject Rights
Under the GDPR, you have the following rights regarding your personal data:

Refund Policy

1. General Refund Terms
QuantumOrbitWorks provides digital services and custom software development. Due to the nature of our services, refunds are evaluated on a project-by-project basis considering the stage of completion and milestones achieved.
2. Cancellation Before Work Begins
If a project is cancelled before any work has commenced, a full refund of any advance payments will be issued within 14 business days, minus any administrative processing fees as outlined in the service agreement.
3. Cancellation During Active Projects
For projects in progress, refunds will be calculated proportionally based on completed milestones:
- Completed milestones are non-refundable.
- Work-in-progress will be billed at the agreed hourly rate for hours invested.
- All completed deliverables and source code for paid milestones will be transferred to the client.
4. Service Quality Guarantees
If delivered work does not meet the specifications defined in the signed Statement of Work (SOW), QuantumOrbitWorks will remedy defects at no additional cost within a reasonable timeframe. If remedies are not feasible, appropriate refunds will be issued.
5. Dispute Resolution
Refund disputes will be handled in accordance with Spanish commercial law and the terms specified in the individual service agreement. Clients may contact us at [email protected] to initiate the resolution process.
Terms of Service

1. Acceptance of Terms
By accessing and using the services provided by QuantumOrbitWorks, located at Calle del Párroco Eusebio Cuenca 54, Piso 7 C, Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.
2. Scope of Services
QuantumOrbitWorks provides enterprise-grade web application development, API integration services, cloud infrastructure management, and related technical consulting. Specific service scope, deliverables, timelines, and pricing are defined in individual Statements of Work (SOW) or service agreements.
3. Client Obligations
- Provide accurate and complete project requirements and specifications.
- Designate authorized representatives for project communications and approvals.
- Make timely decisions and provide feedback within agreed review periods.
- Ensure all provided materials and content do not infringe third-party intellectual property rights.
4. Intellectual Property
Upon full payment, all custom-developed code, designs, and deliverables created specifically for the client under a project agreement are transferred to the client's ownership. QuantumOrbitWorks retains ownership of pre-existing tools, libraries, frameworks, and methodologies used in service delivery.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement. This obligation survives the termination of the service agreement for a period of 36 months.
6. Limitation of Liability
QuantumOrbitWorks' total liability under any service agreement shall not exceed the total fees paid by the client under that agreement. QuantumOrbitWorks shall not be liable for indirect, incidental, special, consequential, or punitive damages.
7. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of Spain. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
8. Modifications
QuantumOrbitWorks reserves the right to modify these Terms of Service at any time. Material changes will be communicated to active clients via email. Continued use of our services following notification constitutes acceptance of the modified terms.
